Terms of Service
Effective date: October 5, 2025
These Terms of Service (“Terms”) are a legal agreement between BeyuByZen LLC d/b/a Portillo Pro Clean (“Portillo Pro Clean,” “we,” “us,” or “our”) and the person or entity who requests services (“you” or “Client”). By booking, accepting an estimate, or allowing our team to perform work, you agree to these Terms.
- Transparent “from” pricing; final price confirmed after a quick scope check.
- Free reschedule up to 24 hours prior; late cancel/lockout fee may apply.
- 48-hour satisfaction window for re-cleans on the areas we serviced.
- We won’t work in unsafe/unsanitary conditions (biohazards, active infestations, etc.).
1) Scope of Services
We provide residential and commercial cleaning in Lubbock, TX and nearby areas. Current offerings include: Standard/Home Cleaning, Deep Cleaning, Move-In/Move-Out, Commercial/Janitorial, and Airbnb Turnover. A detailed “What’s Included” list is on our website; custom scopes can be added in writing.
2) Quotes & Estimates
- Online/phone estimates are ballpark and based on information you provide (size, rooms, condition, frequency, add-ons).
- Final pricing may change after our arrival/scope check if the condition/size differs from the estimate. We will communicate adjustments before proceeding.
- Published “From” prices are minimums and may be adjusted for heavy soil, excess clutter, high/complex surfaces, or special requests.
3) Scheduling, Arrival Window & Access
- We schedule within an arrival window (typically 2 hours) to account for traffic, jobs running long, and weather.
- You are responsible for access (on-site, key/lockbox, or door code). If we cannot access the property within 15 minutes of arrival, a lockout fee may apply (see Section 7).
- Please secure valuables and notify us of alarm codes, pets, or parking instructions in advance.
4) Client Responsibilities
- Pick up toys/clutter and clear sinks/counters as able so we can focus on cleaning.
- Disclose fragile surfaces, pre-existing damage, special finishes (e.g., marble, raw wood, oiled floors), and any product restrictions.
- For Move-In/Out, units should be empty unless otherwise agreed (inside cabinets/appliances/windows included only if listed).
5) Pricing, Taxes & Payment
- Payment is due upon completion unless otherwise agreed in writing. We accept common electronic methods and cards.
- Texas sales tax will be added where required by law (janitorial services are generally taxable in TX).
- Late invoices may accrue a 1.5% monthly late fee (or the maximum allowed by law) and reasonable collection costs/attorney’s fees for recovery.
- Chargebacks without first contacting us to resolve may incur admin fees to cover our costs.
6) Cancellations, Reschedules & Lockouts
- Reschedule or cancel ≥24 hours before your appointment: no fee.
- Changes <24 hours before, or we arrive but cannot access the property: a $55 lockout/late cancel fee (or up to 50% of the quoted job for large bookings) may apply.
- If we must cancel due to illness, vehicle trouble, or severe weather, we’ll offer the next available window.
7) Satisfaction Guarantee & Re-Cleans
- If we miss something, notify us within 48 hours of service with photos/notes. We will return to re-clean the specific area(s) at no charge.
- The guarantee applies to the items/areas included in your scope. It does not cover normal resoiling after use, or conditions outside our control.
8) Breakage, Damage & Exclusions
- Please put away fragile/irreplaceable items. We are not liable for items that were unstable, improperly installed, previously damaged, or of high fragility (e.g., art, heirlooms, loose fixtures, brittle blinds, unsecured TV mounts).
- Report any damage within 48 hours. We may repair or replace with a comparable item at our discretion.
- Liability cap: Except for gross negligence or willful misconduct, our total liability is limited to the amount you paid for the service giving rise to the claim or $500, whichever is less.
9) Health, Safety & Hazardous Conditions
- We do not handle biohazards (blood, feces, urine), mold remediation, hoarding cleanup, asbestos/lead paint, insect/rodent infestations, or any unsafe conditions.
- We do not move heavy furniture/appliances, climb above a 2-step ladder, or clean exterior windows/roofing.
- If a condition is unsafe or unsanitary, we will pause/decline service and discuss next steps. A partial fee may apply for time on site.
10) Supplies & Equipment
We bring our own professional, eco-friendly supplies and tools. If you request we use your products/equipment, we are not responsible for results or damage caused by those products/equipment.
11) Pets
We love pets. Please secure animals that may be anxious with visitors, and tell us about any special instructions. We do not clean up pet waste, litter boxes, or accidents.
12) Photos, Reviews & Testimonials
With your consent, we may take “before/after” photos that do not reveal personal identity or address for quality assurance and marketing. You can opt out any time by telling us before service or emailing Clean@portilloproclean.com.
13) Recurring Service & Discounts
Frequency discounts (e.g., weekly/bi-weekly/monthly) apply only while the cadence is maintained. If visits are skipped or cadence changes, pricing may be adjusted to the appropriate tier.
14) Promotions, Coupons & Gift Cards
Promos and coupons cannot be combined unless explicitly stated, are not redeemable for cash, and may be limited to first-time customers or certain services/areas. Gift cards are non-refundable and treated as cash equivalents.
15) Non-Solicitation
For 12 months from your last service, you agree not to directly hire or solicit our employees/contractors for services outside Portillo Pro Clean. If this occurs, a placement fee equal to $1,200 or the equivalent of 6 months of your average service total (whichever is greater) may be charged to cover recruiting and training costs.
16) Commercial Clients
- Commercial scopes may include custom checklists, supply replenishment, and after-hours access procedures.
- Unless otherwise agreed, commercial invoices are due upon receipt; net-15/30 terms may be granted after approval.
- Client is responsible for providing safe access and communicating building protocols.
17) Text Messaging Consent
By providing your mobile number, you consent to receive SMS texts related to scheduling, reminders, and updates. Message/data rates may apply. You can reply STOP to opt out or HELP for assistance.
18) Privacy
Your information is handled per our Privacy Policy. We do not sell personal data.
19) Warranties & Disclaimers
Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
20) Limitation of Liability
To the maximum extent permitted by law, Portillo Pro Clean and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, loss of use, lost profits, or data, even if advised of the possibility. In all cases, our aggregate liability is limited as stated in Section 8.
21) Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, and expenses arising from your breach of these Terms or your misuse of our services, except to the extent caused by our gross negligence or willful misconduct.
22) Disputes; Governing Law
These Terms are governed by the laws of the State of Texas. Venue for any action shall be in state courts located in Lubbock County, Texas, unless otherwise required by law. You and we waive jury trial to the extent permitted by law.
Optional arbitration: If you prefer binding arbitration (AAA/JAMS) and class-action waiver, tell us and we’ll provide an arbitration addendum for signature.
23) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, utility outages, accidents, illness, or government actions.
24) Changes to These Terms
We may update these Terms from time to time. The “Effective date” above will reflect the latest version. Material changes will be posted on our website. Continued use of our services after changes means you accept the updated Terms.
